Kimble Opposes Obama Nominee for Supreme Court
[Friend of the blog, Representative Jack Kimble (R-CA) has certainly poked a hornet's nest when he became the first politician to publicly condemn Obama's nominee to replace Justice Stevens on the Supreme Court. While Representative Jon Kyl (R-Az) has threatened to filibuster Obama's nomination he did so in the hypothetical while Congressman Kimble has come out solidly against the as yet unfilled nomination. Here's his open letter, reprinted from his website, which is in my blog roll.]
Today, my friends, the United States Supreme Court is at a tipping point. With the announced retirement of Justice John Paul Stevens, it is extremely important that a suitable replacement is found for Justice Stevens who will support those laws which our government was founded on that still remain popular to this day.
When George Bush was President, he picked two justices in Samuel Alito and John Roberts who were not only the epitome of judicial temperament, but also strict Constitutionalists who follow the ideals our founding fathers had for this country, its people, and its corporations. I had hoped that President Obama would follow President Bush’s lead, but instead he has selected unqualified radicals in Justice Sotomayor and now with his latest nominee.
Right now, the Democrats have a majority, but we must not allow them to pack this court with another radical. We need only look at this nominee’s judicial record to see a long history of supporting liberal special interests and turning their back on the family values and fiscal conservatism that this country was founded on.
As I mentioned earlier, judicial temperament is just as important as strict adherence to the Constitutionalism. That is why I can’t understand why Obama has selected a nominee who is alternately bookishly withdrawn and prone to rage. Surely, there were other potential nominees who were better qualified. Obama’s nominee seems to be defensive about both gender and race in a way that is unbecoming of a justice and would make me wonder if a white male could possibly get a fair hearing in front of them. The nominee has made repeated racist and/or sexist remarks that should disqualify anybody from the highest court in the land.
This nominee has not only shown a fondness for socialist philosophers, but also a liberal bias that will seriously endanger rights that we hold dear like the Second Amendment. I urge everybody to please call your Senator and let them know you will not support such a radical nominee.
Congressman Kimble Applauds Supreme Court Ruling

On Thursday, the Supreme Court voted 5-4 to let corporations spend as much money as they want on campaign contributions. Companies can all buy commercial time to run commercials right through the election. This is great news for the American people.
Some may call this a case of activist judges running amok, but I believe this is what the founding fathers wanted when they first incorporated this country. As a congressman, I have frequently found myself wishing that insurance companies and banks could make their voices heard so I would know how they feel on certain issues—now I can finally hear their side of things. It is great to know that industry can finally have its voice heard.
My father was thrilled to find out that he would no longer have to finance 90% of my campaign alone. For those of you who have been sending in campaign contributions, you have my gratitude, but it is no longer necessary. You can stop sending me money. This is a victory for the little guy to because it was thanks to large organizations like Freedom Works that the Teabag movement was funded.
To corporations I would like to say, “I’m listening.” If there is anything you need, my door will always be open to you. I am very interested in selling the naming rights to my seat in congress much like professional sports teams do. Every time I am interviewed on television, instead of saying Jack Kimble (R-CA) it could say Jack Kimble (R-CA-Citibank) or Jack Kimble (R-CA-PNC). This is tremendous news for democracy and for the robocall industry. After all, corporations who need other corporations are the luckiest corporations in the world.
The War Over Halloween
It has been a great Halloween at the Peele household so far. My 13 year old daughter Emily and I are here this afternoon before she goes to a party tonight. Emily is dressed as a Sexy Supreme Court Justice. She was very inspired by Justice Sotomayor’s hearings (don’t ask me why), but the only costumes they make for girls anymore are all sexy. In the past, instead of passing out candy I have put an empty bowl on the porch with a note that said “Honor System, Take Only One Please”. That seemed to work just fine. Emily was always after me to pass out actual candy, but with my daughter barely at 5″7″ and pushing 120 pounds you can guess where half that candy was going to wind up.
As my longtime readers know, Halloween is very important to me. There is a radical atheist movement in this country that is trying to remove all traces of Halloween’s Christian origins from the holiday. This year I decided that I would give all trick or treaters Chick Tracts. These are great comics that warn children of the dangers of sinful things like murder, homosexuality, Catholicism, and Dungeons and Dragons (2nd edition–3rd and 4th have yet to be declared evil, possibly because they use d20 systems). The look of surprise on the faces of the neighbor children as I pass them out has been well worth it.
When we give into the radical atheists who wish to dechristianize Halloween we all lose. We can’t allow the pagans and atheists who would take over this Christian holiday to have their way. I get so irritated when I hear somebody wish me a happy pumpkin day because I know that they have avoided wishing me a Happy Halloween. Remember, something hallow is something holy–what is a pumpkin day? It just isn’t the same thing. Well, it’s time for me to drive Emily to her little party–I can’t believe how girls dress nowadays. I guess I’m lucky that she’s fat and not very attractive. Have a great Halloween everybody!!

I have to admit that the Sotomayor hearings have been one big snooze fest. The only reason I’ve kept it on at work is so that I can show my Hispanic employees how unqualified the woman really is. Yesterday, I did get a bit into it as Lindsey Graham was grilling Sotomayor. I was very proud of Senator Graham for doing it all by himself without John McCain there. I feel like he’s really starting to spread his own wings.
Anyway, Lindsey Graham found a unique way to question Sotomayor and that was by using anonymous quotes that some lawyers made in the Almanac of the Federal Judiciary. In that book several anonymous lawyers called Sotomayor a bully, one said she was terror from the bench, a third one said “Like oh my God! Did you see what she was wearing under her robes? Hid-e-ous”.
Today, one of those Democrats tried to defend Sotomayor by using anonymous positive quotes. The more I think about it the more I think that maybe in the 21st century that is the way we should evaluate judges and pretty much everything. We already do it on sites like Amazon.com and Ebay where we look at feedback. Let’s bring the same technique to the Supreme Court nomination. Assuming that Sotomayor is going down in flames let’s apply this test to my first choice–Judge Mathis.

- “Judge Mathis deserves to be on this list simply because he happens to have the most finely tuned bullshit detector I’ve ever seen. Nothing gets past him. Sometimes he plays along with someone when he knows they’re lying, letting the person build a complex house of contradictions thatched together with bullshit so he can come back and stomp everyone’s ass in the court room. Judge Judy, Joe Brown, and “Texas Justice” Larry Joe have nothing on him. Mathis could chew them up and spit them out like a pile of soggy sausages. He’s part Shaft, part Matlock (the non-flaccid, non-geriatric part), and all badass. Hail Mathis.”
Now those are simple anonymous quotes from the web. If you google them you can find where they’re from, but I think it really shows you just what a great Supreme Court Justice Judge Mathis would make. Shaft meets Matlock is nothing to take lightly regardless of his views on any particular case. Let’s start pushing Obama to nominate Judge Mathis now.
Judge Sotomayor is Dangerously Unqualified
When you look at the qualifications necessary to be a successful Supreme Court Justice, it is clear that Judge Sonia Sotomayor has none of these traits. Her appointment is yet another disastrous move by President Obama when our country can least afford it. Let’s take a look at her legal career so far:
1. Judicial Temperament: No less an authority than Karl Rove called Sotomayor “a bully” and “domineering” today on Fox News. As a diabetic she may be prone to bouts of drowsiness or hyperactivity. Worst of all is her IQ. Rush Limbaugh pointed out that unlike himself, she’s no intellectual heavyweight.
2. Radical Activism: Recently Yakin v. Tyler Hill Corporation, Inc. was heard by the 2nd Circuit Court of appeals where Sotomayor is a judge. In their ruling they said, “To the extent that a forum selection clause binds diverse parties by its express terms to a specific jurisdiction that is not federal, it waives a statutory right to remove…However, where, as here, the clause merely contains obligatory venue language, it conveys nothing about the parties’ intent as to jurisdiction.”
Is this the kind of sloppy work we can expect from her on the Supreme Court? Forum selection clauses are a keystone of contract law in this country. While they affirmed the lower courts decision, they did so without any attention paid to the reasoning behind the ruling. I hope conservative groups nail her on this one.
3. Conflict of Interest: She may have to hear cases on immigration law. As a Hispanic, she has a definite conflict of interest.
4. Other more deserving candidates: Like Judge Sotomayor, Judge Greg Mathis also brought himself up from poverty. He was the youngest Judge in the State of Michigan. They even wrote a musical about his life called “Inner City Miracle.” He is a no nonsense Judge who can solve several difficult cases in a half hour. Frankly, the court can use his speed.
We need to make sure that Judge Sotomayor is not placed on the Supreme Court by Obama and the liberals in congress. Let your congress people know that Judge Mathis is your choice.
Obama Opposes Strict Constitutionalist Judges
One of the strongest points of the McCain campaign is his desire for strict Constitutionalist judges. By that he means judges who will follow the Constitution the way it was written by the founding fathers. Obama makes no such claim. Why is that?
Evidently Obama thinks he knows better than our founding fathers or maybe he believes that its too hard to find out what people living 230 years ago were actually thinking at the time. As if he never heard of David McCullough.
Maybe Obama doesn’t like the fact that the founding fathers themselves couldn’t agree on much. He doesn’t know if he supports the James Madison or Patrick Henry view. Maybe he doesn’t know if he should count the Bill of Rights or not. Obviously, since the Bill of Rights weren’t included in the Consitution they really don’t apply. That should be obvious.
Let’s quit trying to legislate from the bench. If the Constitution says that the vote should be reserved for white, protestant, landed, men who are we to tell the founding fathers they were wrong? Obama should be a man or at least 3/5 of one and agree to run this country by the wishes of the founding fathers who established it in the first place.
Liberal Justices Threaten Gitmo
Habeas Corpus is a Latin term that means “Have the body”. Basically, it means you can’t imprison somebody unless you have their body. This is not only obvious, but this simple overrated term has America ready to open the gates of Gitmo and let the terrorists go free. Obviously, we have their bodies or we couldn’t have them at Gitmo, but that wasn’t enough for Justice Kennedy. I’m sorry, but the Gipper dropped the ball on this one. He should have seen that last name and run.
Now, terrorists at Gitmo will be free to petition to American courts over their detention. Once they do this they have a very good chance of being freed and the next thing you know they’ll be ready to attack us again. American rights should not apply at Gitmo. It is part of Cuba.
This had me so close to donating money to John McCain. We need strong constitutionalist judges that won’t sacrifice national security for some stupid little Latin phrase. America deserves better than this from its Supreme Court. We need to stop legislating from the bench and get back to the rules the founding fathers established for us in the Constitution.
McCain Predicts Supreme Court Decided Election
People have taken McCain’s comments about winning it all in January to be yet another senior moment like the Iraq troop draw down confusion earlier this week. It has been a stressful election and that is certainly possible. However, maybe that slip of the tongue was the result of McCain accidentally letting out that like in 2000, the Supreme Court will need to resolve this election. He also may have been taking about the one map I saw which projected to 269 electoral votes each for McCain and Obama which would require the House of Representatives to decide the election. In any event, it seems that there is more to this than yet another “senior moment”.
California Court Overturns Gay Marriage Ban

First, let’s ignore the fact that its gay marriage that we’re talking about here. The main issue I want to discuss is the fact that one vote on the state court overturned the will of millions of Californians who voted for a ban on gay marriage. Let me repeat this–One vote in the state court overturned the will of millions of Californians.
Activists judges are the most disgusting creatures on the planet. The courts have their place, but it isn’t going against the will of the American people. That right should be reserved only for the U.S. Supreme Court and only then in special cases like Presidential elections. This isn’t something that state courts should be allowed to do willy nilly. The courts should not be allowed to get away with this and I hope President Bush will do something about it.
Hillary Supporters We Want You
A good friend of my blog is Zenyenta http://zenyenta.wordpress.com/ . She is very much like an aunt to me and you don’t disown an aunt simply because she forgets to take her medication. You see, Zenyenta is an unabashed liberal. Recently she posted this on the blog:
“You’d prefer McCain to nominate the next SCOTUS judges than Obama? I think the RNC would like to send you a check. If they haven’t already.”
Assuming a miracle doesn’t happen and Obama wins the Democratic nomination (In politics I know that is a big assumption) I want to put out a call to all you Hillary Clinton supporters. We want to make common cause with you to help defeat Barrack Hussein Obama in the November election and put John McCain in office.
A lot of people will try and scare you. For example they’ll warn you that John McCain has a terrible temper. Well so did your beloved Lyndon Johnson. A temper doesn’t disqualify you from being President.
They’ll tell you that McCain will pack the Supreme Court with conservatives. That won’t happen. Expect that the judges he nominates will be moderates like John Roberts and Samuel Alito. Some things like abortion may be overturned, but civil liberties will remain for the most part.
They’ll tell you that McCain wants to keep troops in Iraq for 100 years, but remember we’ve been in Japan that long too. Its not like we’ll be fighting 100 years. I would guess 10 more years tops.
They’ll tell you that McCain is out of touch with the financial crisis. His chief financial adviser is Phil Gramm who knows economics and who is responsible for cutting a lot of annoying red tape out of the way of financial institutions.
In short, things will continue much as they have. This is a lot better than the nightmare that we all know will occur if Obama gets in. Together we can defeat him. With the war and looming recession we Republicans can’t do it on our own. Let’s defeat Obama together!
